Former Tobacco Commission CEO Joseph Chidanti Malunga Files Lawsuit Against Comptroller of Statutory Corporations

Joseph Chidanti Malunga, the former CEO of the Tobacco Commission, has filed a lawsuit against Peter Simbani, the Comptroller of Statutory Corporations, challenging the appointment of commissioners to the Tobacco Commission. The appointments, made on February 9, 2024, are being contested for lacking statutory authority and for bypassing the involvement of Agriculture Minister Sam Kawale.

Malunga has also named Minister Kawale as the second defendant, alleging that he failed to fulfill his statutory duty to oversee the appointments. In the lawsuit, Malunga is seeking judicial review and has applied for permission to do so outside the prescribed time frame.

According to court documents, the legal challenge was filed at the High Court in Lilongwe on August 26, 2024. Malunga is also requesting an interlocutory injunction to prevent the appointed commissioners from carrying out their duties until the court makes a final ruling or issues further instructions.

The outcome of this case could have significant implications for governance at the Tobacco Commission, particularly regarding the legal processes involved in appointing its leadership. The lawsuit may either reaffirm or challenge the way statutory mandates are executed by government officials in such appointments.
