Court Orders Stay of Execution and Suspension of MCP Convention

The Supreme Court of Appeal has granted an order staying the execution of a High Court judgment related to the Malawi Congress Party (MCP) convention.

The order was issued by Justice Madise JA on August 7, 2024, pending the hearing and determination of an interpartes application.

*Conditions of the Order:*

1. The MCP must file an interpartes application within 7 days.

2. The respondent must respond with arguments within 7 days of being served.

3. The interpartes application will be heard 7 days after the response is filed.

4. The MCP convention is suspended until the application is heard and determined.

*Additionaly:*

– Costs will be determined by the court.
– The order was made at the Supreme Court of Appeal in Blantyre, Malawi.
