No gaps in the Zambian Constitution, Says Lawyer Charles Chisangano

Zambian lawyer Charles Chisangano has dismissed claims that the country’s Constitution contains significant gaps or lacunas, asserting that the document is comprehensive and capable of addressing the nation’s legal challenges. Speaking at a legal forum in Lusaka, Chisangano emphasized that any perceived shortcomings in the Constitution stem from misinterpretation or poor enforcement rather than actual flaws within the text.

“There are no lacunas in the Constitution of Zambia,” Chisangano stated. “The Constitution is clear and provides guidance on various aspects of governance, legal processes, and individual rights. The problems we face are due to a lack of proper application and understanding of these provisions.”

In recent years, Zambia’s Constitution has been the subject of scrutiny, with critics pointing to issues related to governance, electoral law, and the separation of powers. While some stakeholders have called for amendments, Chisangano believes that the Constitution is flexible enough to handle these matters through judicial interpretation.

Chisangano pointed out that the Constitution is designed to evolve through the judiciary’s role in interpreting the law. “The judiciary has the power to clarify any ambiguities, ensuring that the Constitution remains relevant as Zambia develops,” he added.

His comments come amid ongoing discussions about constitutional reforms in Zambia, especially concerning the balance of power between the executive and other branches of government. Chisangano’s stance, however, suggests that the solution lies in improving legal adherence and governance practices rather than rewriting the document itself.

This view has sparked debate in legal circles, with some agreeing that the Constitution is sound, while others argue that reforms are necessary to address Zambia’s changing political landscape.
