Supreme Court dismisses Nankhumwa’s Appeal Case with Costs
Malawi Supreme Court of Appeal Judge Justice Dorothy NyaKaunda on Wednesday dismissed an appeal case applied by Leader of Opposition in Parliament Dr. Kondwani Nankhumwa and two others, challenging the decision made by DPP President Professor Arthur Peter Mutharika assigning them other responsibilities in the party.
Nankhumwa, Grezelder Jeffrey and Cecilia Chazama wanted the Supreme Court of Appeal to nullify the decision made by Mutharika at the Party’s National Governing Council (NGC) which was held in Mangochi district on 13th December, 2023.
In a dust refuses to die for Nankhumwa and two others, last week, High Court Judge Howard Pemba dismissed the same case with costs but lawyer of the three, Cassius Chidothe indicated to the court that he will take the matter to the Appeal Court.
Nankhumwa and two others, argued that Professor Mutharika has no powers whatsoever to remove them from their positions claiming that they were voted into those positions in 2018 at the DPP elective conference by the majority of delegates.
Nankhumwa’s loss in a case against Professor Mutharika and the DPP marks the close of a long battle of crossing swords through court injunctions against injunctions raising fears among the DPP supporters that the party might go to the 2025 elections without a presidential candidate.
Social media users are sending best wishes to the DPP and its President Professor Mutharika for winning a court case against Nankhumwa and two others, claiming that this the second time to win the case since 2019.
Meanwhile, a Democratic Progressive Party (DPP) Youth Governor for Lilongwe Urban speaking on a strict condition of anonymity, has predicted the fall of Nankhumwa in politics expressing doubtful if he will retain the Mulanje Central Parliamentary seat in 2025.
The Governor has advised Nankhumwa, Grezelder Jeffrey and Cecilia Chazama that all is not lost, there is still time to apologize to the party’s leadership kneeling down for forgiveness in to error is human and to forgive is divine.
“Swallow your pride and apologize to the party’s leadership, you will be forgiven so that the honor and dignity is not lost,” he said.
