DPP files stay High Court judgement pending appeal

The Democratic Progressive Party (DPP) has filed an application for a stay of the High Court judgement pending appeal to the Supreme Court of Appeal.

The Central Executive Committee of the Party met on Saturday to consider the judgement of the High Court of Malawi issued on 29th September, 2023 nullifying the resolutions of the National Governing Council (NGC) meeting held on 3rd July, 2023 and ordering the Party to hold its elective convention within 90 days.

On 3rd July, 2023 delegates to the DPP National Governing Council (NGC) resolved that the Party to hold its elective convention in July, 2024 and elected Former President of the Republic who is also the Party’s leader Professor Arthur Peter Mutharika as its torchbearer in the 2025 elections.

The resolutions passed did not please some senior members of the Party who individually claimed that the decision was reached in the presence of all and that there was no time to give them a floor to speak, one of them being Ken Msonda who for several time had to raise his hand for a point of order but he was deliberately not recognized.

In the meeting, DPP Party members and followers through the Central Executive Committee resolved to apply for a stay of the judgement pending appeal to the Malawi Supreme Court of Appeal.

“While the DPP respects orders of the courts, it is also within its rights to appeal to the Malawi Supreme Court of Appeal,” reads part of statement dated 1st October, 2023.

The DPP has appealed to all of its members and followers to remain calm until the outcome from the Malawi Supreme Court of Appeal is known.

Meanwhile, one of the DPP Youth Governors in Lilongwe City speaking on a strict condition of anonymity has blamed the MCP for doing everything possible through court judges that the DPP goes to the 2025 elections without a Presidential candidate.

The Governor has made a strong observation that all cases against the DPP in court are being heard by two justices; Simeon Mdeza and Kenyatta Nyirenda, the Party has not won any case describing this as very unfortunate in the period of democracy.

He expressed hope and confidence that since the issue has been filed to the Supreme Court of Appeal justice will finally be delivered.

“This time around, our case will be heard by neutral justices of the Court of Appeal for the truth to prevail,” said the Governor.
