Man gets 14 years for defiling 6-year-old brother’s daughter
The Mzimba First Grade Magistrate’s court on August 15, 2022 convicted and sentenced a 55-year-old man, Masida Lusale, to 14 years imprisonment with hard labour for defiling a 6-year-old brother’s daughter.
The court through police prosecutor Sub Inspector Henry Mkweche heard that on August 6, 2022 the convict called his brother’s 6-year-old daughter into his house within the compound as they are neighbors.
Later the girl started crying which prompted the elder sister to the victim follow up. She found them doing sexual intercourse.
The matter was reported to their father, who in turn reported to police.
Lusale was arrested two days after the incident.
Appearing before court, the accused person pleaded guilty to a charge of defilement.
In mitigation, the convict asked for court’s leniency, saying he is the breadwinner to his family.
In his submission, police prosecutor Sub Inspector Mkweche pleaded with the court for a stiffer punishment, citing that the convict was suppose to play a fatherly role by protecting a girl child.
Passing sentence, First Grade Magistrate Radson Gamaliel concurred with the police prosecutor’s submission hence sentenced him to 14 years imprisonment with hard labour.
Masida Lusale hails from Chikondawanga Village in Traditional Authority Mzikubola in Mzimba District.
